Notice of Proposed Settlements

Texas residents have begun receiving a postcard entitled Notice of Proposed Settlements regarding real estate commission antitrust lawsuits. Many are asking why they are getting this notice and what does it mean?


The notices being sent relate to the Burnett et al v. NAR et al and Moehrl et al v. NAR et al antitrust lawsuits. Defendants Anywhere Real Estate, Inc., RE/MAX, and Keller Williams Realty, Inc., have agreed to settle these suits with the plaintiffs.


These types of notices are common in class action litigation. The notices help explain what rights potential class members have under the proposed settlement. The court must give its approval before the proposed settlement becomes final.


Whether an individual homeseller is included in the class and entitled to receive any benefits depends on several factors including which MLS was used to list the property and when the property sold. Additionally, individuals must submit a claim form by May 9, 2025, to be eligible to receive the benefits of the settlement.

It’s important to note that these notices only relate to the Burnett and Moehrl antitrust lawsuits and not to the many copycat lawsuits that have been filed since the Burnett verdict.
